1. Agreement to these Terms
These Terms of Use (“Terms”) govern your use of Kartee (“Kartee” or the “Service”): the Kartee iPhone app, the Kartee staff web app at app.kartee.tech, and the digital menus restaurants publish with it. Kartee is provided by Hypebox through Hypebox Media SARL (Beirut, Lebanon) and Hypebox For Marketing and PR (Dubai, United Arab Emirates) (“Hypebox”, “we”, “us”).
By creating an account or using the Service you agree to these Terms and to the Kartee Privacy Policy. If you use Kartee for a restaurant or company, you confirm you may accept these Terms on its behalf.
2. Definitions
- Customer: the restaurant, café or business that holds a Kartee account.
- User: a person the Customer lets sign in (owner, manager, general, waiter or kitchen role).
- Guest: a person who opens a Customer’s menu, places an order or sends a table request.
- Customer Content: everything a Customer and its Users add, such as menus, photos, prices, tables and orders.
3. Accounts and eligibility
- You must be at least 18 and give accurate account information.
- Keep your password and sign-in codes private. You are responsible for activity under your account.
- The account owner controls the account: who is invited, which role each User has, and the plan. Each role sees and does only what it needs (for example, kitchen staff do not see payments; waiters do not change portion counts).
4. The Service
Kartee lets a Customer publish a digital menu, take orders from tables through QR codes, receive orders and table requests, run a kitchen screen and see statistics. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your business during your plan.
- Prices and orders. The Customer sets its menu, prices, taxes, service charges and availability, and is responsible for them. Kartee passes orders from guests to the Customer; the order is between the guest and the Customer. Guests pay the Customer at the table; Kartee does not take payments from guests.
- Food information. The Customer is responsible for the accuracy of dish descriptions, allergens, calories and any other food information it publishes, and for meeting food, tax and consumer rules where it operates.
- We may improve, change or remove features. Features marked as preview or beta may change or stop.
5. Plans, trials and billing
- New restaurant accounts include a 14-day free trial, once per person. When a trial or plan ends, the menu goes offline for guests and ordering stops until a plan is active; your content is kept.
- Plans limit the number of Users and branches (for example, Starter: 4 Users and 1 branch; Growth: 12 Users and 3 branches). Larger needs are offered as Enterprise by agreement.
- Prices are shown before you buy. Prices may change for future billing periods with reasonable notice.
6. Subscriptions bought in the iPhone app
- Plans bought in the Kartee iPhone app are auto-renewable subscriptions sold and billed by Apple.
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically for the same period (monthly or yearly) at the then-current price unless it is cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel the subscription in your iPhone’s Settings › Apple Account › Subscriptions. Deleting the app or your Kartee account does not cancel it.
- Refunds for App Store purchases are handled by Apple under its policies (reportaproblem.apple.com). Switching between Starter and Growth is handled by Apple as an upgrade (right away) or a downgrade (at the next renewal).
- A plan bought in the app applies to the restaurant account it was bought for and is managed by that account’s owner. An account pays through one channel at a time: the App Store or a card on the web.
- As between you and Apple, Apple is not responsible for the Service or its content and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms for the iPhone app and may enforce them. Your use of the app must also follow the Apple Media Services terms.
7. Plans paid by card on the web
Plans bought on the web are billed in advance by card through Stripe and renew automatically each month or year until cancelled. You can cancel at any time from Settings › Plan & billing; the plan stays active until the end of the paid period. Fees are not refundable except where the law requires. Taxes are added where they apply.
8. Customer Content
- It is yours. The Customer owns its Customer Content. We do not claim ownership of it.
- License to us. You allow Hypebox to host, store, process, display and send Customer Content only to provide, secure and improve the Service, including showing your menu to the public at your menu link.
- Your responsibility. You confirm you have the rights to the photos, names, logos and text you upload, and a lawful basis for any guest or staff personal data you collect through the Service.
9. Acceptable use
You agree not to:
- break the law, or publish content that is unlawful, misleading, infringing or harmful;
- sell items you are not allowed to sell, or use the Service for anything other than a genuine food or drink business;
- try to access other accounts or our systems, get around limits or security, or overload the Service;
- send spam or malware, or collect guest data for purposes they were not told about;
- copy, resell or reverse engineer the Service, except where the law allows.
We may remove content or suspend accounts that break these rules.
10. Third-party services
Kartee works with services such as Apple (App Store, push notifications, Sign in with Apple), Google (sign-in and review links), Stripe and email delivery. Their own terms apply to your use of them, and we are not responsible for them.
11. Intellectual property
The Service, the Kartee name and logo, and our software and designs belong to Hypebox. These Terms do not give you any right to them except to use the Service. If you send us feedback, we may use it freely.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT EVERY ORDER OR NOTIFICATION WILL ARRIVE. KEEP A WAY TO TAKE ORDERS WITHOUT KARTEE IF YOU RELY ON IT.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, ORDERS, DATA OR GOODWILL.
- HYPEBOX’S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR USD 100 IF YOU PAID NOTHING).
Some jurisdictions do not allow these limits, so some may not apply to you.
14. Indemnification
You agree to indemnify Hypebox against claims, damages and costs (including reasonable legal fees) arising from your Customer Content, your menu and prices, your dealings with guests, or your breach of these Terms or the law.
15. Ending your use
- You can stop using Kartee at any time. Delete your account in the app (Account › Delete account) or by emailing info@hypebox.agency from the address you sign in with. Cancel any App Store subscription separately in your iPhone’s settings.
- We may suspend or end access if you break these Terms, do not pay, create risk or legal exposure, or if the law requires it.
- After an account ends, you may ask for a copy of your Customer Content within a reasonable period; we then delete it as described in the Privacy Policy.
- Sections that by their nature should survive (such as ownership, disclaimers, liability and governing law) survive.
16. Changes to these Terms
We may update these Terms. For material changes we will update the “Updated” date and give reasonable notice. Continuing to use the Service after changes take effect means you accept them.
17. Governing law
These Terms are governed by the laws of Lebanon. The courts of Beirut, Lebanon have exclusive jurisdiction, except that either party may seek urgent relief in any competent court to protect its intellectual property or confidential information. Nothing in these Terms limits rights you have under the consumer law of your country.
18. General
- These Terms and the Privacy Policy are the whole agreement between you and Hypebox about the Service.
- If a provision is unenforceable, the rest stays in effect. Not enforcing a provision is not a waiver.
- You may not transfer these Terms without our consent; we may transfer them with a merger or sale of assets.
- Neither party is liable for delays caused by events beyond its reasonable control.
